Terms Of Service

1 Overview and Agreement

These Terms of Use and Services (the “Terms”) constitute a legal agreement between Ignite Sauna & Cold Plunge Inc. (“Ignite,” “we,” “us,” or “our”) and each person or organization that accepts them (“you” or “your”). Where a provision uses “I,” “me,” or “my,” it refers to the individual personally accepting that provision.

The “Website” means Ignite’s website at https://www.ignitesaunacoldplunge.ca, authorized booking pages, and customer mobile applications.

The “Services” include the Website, sauna only and cold-plunge-only sessions, Ignite Reset sessions, Private Suite reservations, passes, packs, credits, memberships where offered, events, and other activities offered or organized by Ignite.

Please read these Terms before creating an account, purchasing, booking, or participating. Where presented for acceptance, signing or selecting an initially unchecked acceptance control through Ignite’s approved process confirms your agreement to the version provided to you. Do not accept these Terms or proceed with a purchase if you do not agree to them or understand them.

These Terms apply alongside the Privacy Policy, conditions clearly disclosed for your purchase or booking, and the separate Waiver Agreement required for physical participation. The Privacy Policy explains Ignite’s handling of personal information; acceptance of these Terms does not itself provide consent for every use of personal information or for marketing.

Purchase-specific conditions govern the session service, price, validity period, and booking rules expressly stated in the accepted offer. The separately accepted Waiver Agreement prevails over a directly conflicting provision concerning physical participation risks, releases or liability arising from physical participation or use of the Facility.

2 Services and Facilities

Services may include instructor-led or self-led, Ignite Reset sessions, sauna-only sessions, cold-plunge-only sessions, breath work and other scheduled wellness experiences, and exclusive Private Suite reservations, as described in the applicable offering.

The “Facility” includes premises operated or used by Ignite in connection with the Services, including saunas, cold plunges, tub steps, benches, showers, changing areas, washrooms, lockers, social areas, reception, corridors, entrances, exits, and associated equipment and amenities. Use of the Facility includes arriving, waiting, moving through, and leaving in connection with your visit.

A booking reserves only the service, time, and number of guests stated in the confirmation. Session duration does not guarantee continuous heat or cold exposure. Check-in requirements and any separate allowance for social time will be disclosed through the applicable Website and booking information.

3 Eligibility and Medical Suitability

You must be at least 18 years old to participate. You must provide accurate and current registration and intake information and satisfy Ignite’s lawful participation requirements. Ignite will consider accessibility and accommodation requests in accordance with applicable law.

Under Ignite’s participation policy, you must not participate if you are pregnant, breastfeeding, have epilepsy, or have a history of fainting. Medical clearance does not override these exclusions. By participating, you confirm that none of these exclusions applies to you.

If you have any other medical condition, cardiovascular concerns, or take medication that may affect your response to heat or cold, or you are uncertain about your suitability, consult a physician and obtain medical clearance before participating. Do not participate contrary to medical advice. Medical clearance does not eliminate participation risks or guarantee admission where a safety concern remains. It is your responsibility to make sure you are fit both physically and medically and that you can participate in the Facility.

Ignite provides recreational wellness services. Its staff and instructors do not provide medical assessment, diagnosis, treatment, medical supervision, or medical clearance. Guidance from an instructor does not replace advice from your physician. No particular health, recovery, or fitness outcome is guaranteed.

4 Safety and Staff Directions

Follow posted rules, safety notices, and staff instructions; shower as directed; observe exposure session and occupancy limits; and use equipment only as intended. Stay within your own limits. Do not participate while impaired by alcohol, recreational drugs, or any substance that affects safe participation.

Never practise breath holding or deliberate hyperventilation in a cold plunge. Do not pressure another person to enter heat or cold, stay longer, or exceed their comfort or physical limits.

Stop the activity, leave the equipment safely, and notify staff immediately if you experience chest discomfort, dizziness, faintness, difficulty breathing, confusion, loss of coordination, or other concerning symptoms. Do not continue to complete a suggested exposure time or keep pace with another guest.

The Facility includes wet or slippery floors, hot surfaces, cold water, temperature changes, and steps or changes in floor level. Walk carefully, particularly when entering or leaving saunas and plunges. Do not run, dive, bring glass into wet areas, interfere with equipment, or enter restricted areas.

Ignite may stop or modify a session, restrict access, refuse participation, or require a person to leave where reasonably necessary because of unsafe conduct, a medical concern, equipment conditions, or an emergency. Comply promptly with evacuation and safety directions. Any financial consequence is subject to Section 12.

Where staff reasonably believe urgent assistance is needed, they may contact emergency services and provide available first aid within their training. You are responsible for ambulance, transportation, or external medical charges legally payable by you.

5 Assumption of Risks and Required Waiver Agreement

PLEASE READ CAREFULLY. PARTICIPATION REQUIRES PERSONAL ACCEPTANCE OF IGNITE’S SEPARATE WAIVER AGREEMENT, WHICH AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO SUE FOR NEGLIGENCE.

Sauna use, cold-water immersion, contrast therapy, breathing activities and use of the Facility involve risks, including burns, cold shock, breathing difficulties, changes in blood pressure, fainting, cardiovascular events, drowning, slips, falls, illness, permanent disability, death and property loss or damage. Risks may arise from premises conditions, equipment, other participants or the acts or omissions of Ignite and others, including negligence.

Before participating, every adult must personally review and affirmatively accept Ignite’s separate Waiver Agreement through Ignite’s approved acceptance process. The Waiver Agreement contains detailed risk acknowledgments, an assumption of risks, a release of claims including claims for negligence, a promise not to sue, an indemnity and an alternative liability limit.

Acceptance of these Terms does not replace acceptance of the Waiver Agreement. A purchase, booking or payment does not authorize anyone to accept another adult’s waiver or release that adult’s claims.

Every participant must complete the required intake, personally accept these Terms and separately accept the Waiver Agreement before admission. These requirements apply to paid and complimentary visits and to every Private Suite guest, including guests attending under a booking purchased by someone else. The purchaser must inform invited guests of these requirements.

Ignite may refuse participation until these requirements are completed. Any resulting cancellation, credit, refund or forfeiture is governed by Section 12.

These Terms and the separately accepted Waiver Agreement operate together. The Waiver Agreement prevails over a directly conflicting provision concerning physical participation risks, releases or liability arising from physical participation or use of the Facility. These Terms and the applicable purchase conditions govern purchases, bookings, cancellations and refunds.

Nothing in these Terms excludes liability or restricts any right or remedy that cannot lawfully be excluded or restricted.

6 Accounts and Security

Provide accurate, complete, and current account and contact information, and update it when necessary. Ignite may reasonably restrict account access if materially inaccurate or incomplete information is provided.

Keep your login credentials confidential, choose a strong password, and take reasonable steps to prevent unauthorized access. You are responsible for activity carried out by you or people you authorize to use your account. Do not share your password, impersonate others, or sell or transfer your account. Any permitted transfer or sharing of purchased sessions remains subject to the purchase conditions.

Notify Ignite promptly of suspected unauthorized account use or a security breach through the contact details in Section 27. Do not send passwords or full payment-card details by email. Ignite may reasonably restrict or terminate access while investigating misuse, protecting account security, fraud, or addressing a material breach.

7 Reservations and Arrival

Reservations are subject to availability and are confirmed when Ignite or its booking platform issues a confirmation. Buying a pack, pass, or membership does not itself reserve a particular session. Walk-ins are subject to available capacity and must be entered into Ignite’s booking system.

Please arrive 10 minutes before your session to allow time for check-in and required documents. Late admission is permitted only where safe and operationally feasible. Your booking will end at the original scheduled time.

8 Private Suite Reservations

A Private Suite booking reserves exclusive use of the suite during the confirmed time for the purchased party size, up to four participants and subject to approved occupancy limits. Select the correct party size.

Each attending guest must be registered, meet eligibility requirements, complete the required intake, acknowledge having reviewed the Privacy Policy, personally accept these Terms, and separately accept the Waiver Agreement.

This also applies when the purchaser is not attending. The purchaser remains responsible for booking charges expressly accepted but cannot sign another adult’s personal injury release.

9 Prices and Payment Authorization

Prices are in Canadian dollars unless expressly stated otherwise. All prices exclude taxes. Before payment confirmation, Ignite will disclose the service purchased, applicable taxes and total payable. Payment is due at purchase.

Use a payment method you are authorized to use and provide accurate billing information through approved secure interfaces. By completing checkout, you authorize the displayed purchase. Saving a card does not authorize unrelated charges or recurring payments.

Recurring charges require your express agreement to the amount or calculation method, frequency, renewal terms, and cancellation conditions disclosed at purchase. Any cancellation or missed-session charge must also be disclosed and accepted. If payment is declined or outstanding, Ignite may request another payment method before confirming or providing the affected Services.

If a pricing error is identified before a purchase is accepted, Ignite may offer the corrected price for your approval or cancel without charge and return any amount collected. After acceptance, changes remain subject to your applicable consent and consumer rights.

10 Stripe and Booking Technology

Ignite uses Mariana Tek for bookings and Stripe to process payments through its Website, approved booking pages, and customer applications. Where offered through Ignite’s customer applications distributed through Apple’s App Store or Google Play, purchases of Ignite’s in-person Services are processed through Stripe.

Payment processing is subject to applicable payment-service terms presented during checkout and the conditions of your payment-method provider. Stripe’s handling of personal and payment information is described at https://stripe.com/privacy. Ignite’s own information practices are described in its Privacy Policy.

Ignite’s disclosed purchase, booking, cancellation, refund, and membership conditions apply across purchase channels. Direct billing enquiries, cancellation requests, and refund requests to Ignite using Section 27.

11 Packs Passes and Memberships

A pass or pack provides the named service or session and number of visits stated in the accepted offer. Packs are service-specific unless otherwise expressly stated. A pack is not automatically a recurring membership.

The Website offer must identify applicable activation and expiry periods, sharing permissions, and restrictions. A purchased entitlement does not guarantee availability at a particular time.

If Ignite offers a recurring membership, its offer must disclose the billing amount and frequency, included Services, minimum commitment if any, renewal arrangements, cancellation process, and any pause or termination conditions. A membership does not authorize charges beyond those expressly agreed.

Future price changes or promotions do not reduce previously purchased entitlements.

12 Cancellations and Refunds

Before purchase or booking, Ignite will show the applicable cancellation deadline, no-show conditions, and any fee or loss of a session or credit.

If you cancel at least 12 hours before an Ignite Reset, sauna-only or cold-plunge-only session, or at least 24 hours before a Private Suite reservation, the applicable booking credit or session will be restored in accordance with your purchase conditions. Restoration does not entitle you to a cash refund or extend any lawfully applicable expiry date unless expressly stated otherwise.

Late cancellations and no-shows result in forfeiture of the session or credit used for that booking, without refund. For a Private Suite reservation, this applies to the entire reservation.

If you have not checked in within 15 minutes after your scheduled session start time, your booking will be treated as a no-show and the session or credit used for that booking will be forfeited without refund. For a Private Suite reservation, this applies if no member of the booked party has checked in within that period.

If Ignite cancels a session, you may choose rebooking or restoration of the applicable session or credit without a cancellation penalty.

Except where required by law, expressly stated in the accepted offer, or provided under this section, purchases are final and non-refundable. Ignite does not otherwise refund unused sessions, credits, or membership time.

Removal for a guest’s misconduct may result in loss of the affected session only where that consequence was disclosed and accepted and is lawful. Removal because of a medical concern, equipment problem, or emergency does not automatically result in forfeiture; Ignite will assess the circumstances and applicable purchase conditions and legal rights.

Send refund and cancellation enquiries to Ignite using Section 27. Approved refunds will ordinarily be returned to the original payment method.

13 Promotions

Promotions, introductory offers, discounts, and referral incentives are subject to conditions disclosed with the offer, including eligibility, availability, redemption instructions, and restrictions on combining offers. Ignite may change offers for future purchases without affecting accepted purchases or benefits already earned.

14 Community Conduct and Guest Privacy

Treat guests and staff with courtesy and respect their privacy, dignity, personal space, and safety. Harassment, discrimination, bullying, threats, violence, sexual harassment, unwanted physical contact, and hateful or abusive conduct are prohibited. Do not disrupt another guest’s experience or pressure others to exceed their limits.

Do not photograph, film, or record another guest or staff member without their express permission. Photography, filming, and recording are prohibited in washrooms, changing areas, and showers. Permission remains subject to posted rules and staff directions.

Do not disclose another person’s personal or health information, private messages, or confidential conversations without permission or other lawful authority. Do not share screenshots of private community discussions without permission from the people whose messages or identifying information appear.

These expectations apply in person and through Ignite’s online communities and communication channels. Ignite may give warnings, stop an activity, require a person to leave, or reasonably restrict future access to address unsafe conduct or a material breach. Financial consequences remain subject to Section 12.

15 Personal Property

Take care of your belongings and use available lockers or storage. Avoid bringing valuables unnecessarily. Ignite cannot guarantee that belongings will remain secure. Subject to Section 5 and any separately accepted Waiver Agreement, Ignite is not responsible for loss, theft, or damage to personal property.

16 Changes to Services

Ignite may update Website content and features and change schedules, instructors, equipment, amenities, service formats, or operating hours. Features may differ between booking pages, applications, and devices. Availability of a feature or offering does not guarantee its continued availability.

Changes or temporary interruptions may be necessary for maintenance, security, safety, or circumstances beyond Ignite’s reasonable control. Where a change materially affects a confirmed booking or paid entitlement, Ignite will give notice as soon as reasonably practical.

Changes do not relieve Ignite of its obligations for accepted purchases.

17 Website Use and Third Party Services

Do not misuse or disrupt the Website, interfere with security, or attempt unauthorized access to accounts, systems, or information. Third-party providers supporting bookings, applications, and payments may present their own terms and privacy policies. Ignite remains responsible for its own obligations to you.

If a technical problem affects a purchase or prevents cancellation of a booking, contact Ignite promptly and provide available details. Ignite will review the circumstances and apply any appropriate remedy under the purchase conditions.

18 Website Liability

The Website is provided on an “as is” and “as available” basis. Ignite does not warrant uninterrupted, error-free, or completely secure operation.

Ignite is not liable for indirect, incidental, special, or consequential losses, including lost profits or revenue, arising from use of, or inability to use, the Website. This section concerns Website technology. Physical participation risks and releases are addressed in the separately accepted Waiver Agreement, which is required under Section 5.

19 Processing Outside Canada

Personal information may be transferred to, stored or processed outside Canada by our service providers. It may therefore be subject to the laws of those jurisdictions, including lawful access by courts, law enforcement or other government authorities. We remain responsible for personal information under our control and require appropriate safeguards for information processed on our behalf.

20 Intellectual Property

Ignite’s names, logos, graphics, photographs, artwork, instructional materials, Website text, and other content are owned by Ignite or its licensors. You may view and use Website content for personal, lawful, non-commercial purposes. You may not reproduce or commercially exploit protected material without the rights holder’s permission.

21 Electronic Communications

You may unsubscribe from SMS messages at any time by replying STOP. After a one-time confirmation message, no further SMS messages will be sent unless you opt in again.

Necessary account and booking communications may continue through other channels, as described in our Privacy Policy.

Ignite may send communications needed to administer your account, purchases, and bookings, including confirmations, reminders, receipts, schedule changes, payment notices, safety information, and notices about these Terms.

Promotional emails or text messages will be sent only where Ignite has obtained any required consent, and messages include required identification and unsubscribe options.

Acceptance of these Terms alone is not express consent to promotional messaging. Your communication choices and Ignite’s information practices are described in the Privacy Policy and applicable messaging disclosures.

Your provider may charge message or data fees. Mobile carriers are not liable for delayed or undelivered messages. Delivery of an electronic reminder is not guaranteed; consult your booking confirmation and contact Ignite if you are uncertain about a booking.

22 Updates to These Terms

Ignite reserves the right to amend, update, or replace these Terms from time to time. Revised Terms will be posted on the Website with an updated effective date. You are responsible for reviewing the Terms periodically.

Your continued access to or use of the Website or Services after revised Terms take effect constitutes acceptance of those Terms. If you do not agree, you must stop accessing or using the Website and Services.

This section does not amend or replace a separately accepted Waiver Agreement. A material revision to that agreement requires the participant’s renewed affirmative acceptance through Ignite’s approved acceptance process. Posting revised documents or continued use of the Website or Services alone does not constitute acceptance of a materially revised Waiver Agreement.

Changes will not retroactively alter accepted purchase conditions.

23 Assignment

Ignite may assign or transfer these Terms, in whole or in part, including its rights and obligations, to another person or entity without prior notice to you or your consent, except as required by applicable law. Any related handling or transfer of personal information remains subject to our Privacy Policy and applicable privacy law.

You may not assign or transfer these Terms or any rights or obligations under them without Ignite’s prior written consent. Any attempted assignment or transfer contrary to this section is ineffective.

Any transfer or sharing of purchased sessions, packs, credits, or memberships remains subject to the applicable purchase conditions.

24 Governing Law and General Provisions

Ontario law and applicable Canadian federal law govern these Terms. Ontario courts have jurisdiction over disputes arising from them.

If a provision is invalid or unenforceable, it will be severed to the extent legally possible without affecting the remaining provisions. A failure or delay to enforce a provision does not itself waive the right to enforce it later.

These Terms and the applicable purchase conditions and separately accepted Waiver Agreement form the agreement concerning their respective subjects.

The parties request that these Terms and related contractual documents be prepared in English, subject to any mandatory language rights. Les parties demandent que les présentes conditions et les documents contractuels connexes soient rédigés en anglais, sous réserve de tout droit linguistique impératif.

25 Waiver of Class Action

You agree to resolve claims or disputes with Ignite on an individual basis. You waive your right to commence or participate in a class action against Ignite relating to the Website, Services, Facility, or these Terms.

This waiver does not apply where consumer protection legislation or other applicable law protects your right.

26 Electronic Acceptance

Initial acceptance of these Terms requires the affirmative acceptance described below. Acceptance of subsequent revisions is governed by Section 22.

Where these Terms are presented for acceptance, you personally accept them by signing or selecting an initially unchecked “I Agree” or equivalent acceptance control linked to these Terms and submitting your acceptance through Ignite’s approved electronic process. You intend that affirmative action to constitute your electronic signature and agreement to the version presented. You may retain or download that version.

Acceptance of these Terms does not constitute acceptance of the separate Waiver Agreement. Each adult participant must personally complete the required intake, accept these Terms and separately accept the Waiver Agreement through the applicable acceptance controls before participating.

These requirements apply to every adult guest, including each guest in a Private Suite booking and anyone whose visit is purchased by another person. A purchaser’s acceptance does not replace another adult’s personal acceptance.

Acceptance of these Terms or the Waiver Agreement does not itself constitute consent to promotional messages or promotional photography.
